Trademarking a clothing brand? This is what we recommend.
Trademarks on clothing should be located on a tag (e.g., a hang tag, a neck tag, a price tag). A trademark identifies and distinguishes the source of the goods of one party from those of others. So, for example, if you see a trademark “X” you can determine the source of the manufacturer of the clothing associated with X. That’s a trademark.
For clothing, what is on the front of the clothing (e.g., a t-shirt) is often considered “ornamental use” and not “trademark use”. Ornamental trademarks may be registered on the supplemental register but, we always recommend to our clients, that are starting a clothing brand, to put that trademark on a tag!
