The following fees are flat attorney fees and do not include USPTO fees. The hourly rate for non-flat fee matters is $350 per hour. Please note that our office hours end at 6 p.m. Eastern USA time. Our Trademark Application Package includes: (1) A “Direct Hit” search of the federal trademark database, (2) all necessary lawyer consultation time (3) preparation and filing of your Trademark Application for a Single Class of Goods or Services ($75 for each additional class), (3) responses to procedural refusals issued by the USPTO (e.g., identification of goods and services, specimen of use, simple clarifications, classification of goods and services and/or disclaimers), (4) status reports, and (5) any phone calls to the Trademark Office regarding your application. USPTO filing fees are currently $250 or $350 per class (USTO filing fees will have a $350 base fee per class starting January 18, 2025. Depending on how the goods and services are defined, there can be additional fees of up to $400 per class for a total of $750 per class). Thus, a typical TM application in a single class is either $750 or $850 with the attorney fee and the USPTO fee (between $950 and $1350 starting January 18, 2025).  A typical TM application in two classes is either $1075 or $1275 with the attorney fee and the USPTO fees (between $1375 and $1775 starting January 18, 2025).  (Please note that the USPTO no longer automatically sends physical trademark certificates. If you want a physical certificate, you will have to order a trademark certificate from the USPTO)

It is our policy that we do not refund or credit any fees paid to the trademark office, such as filing fees or to other third party fees associated with filing your trademark application nor do we refund the attorney fee once a trademark application or response has been filed. Furthermore, we cannot guarantee the results or outcome of your trademark application because the trademark office may reject a trademark application for reasons beyond the scope of work covered by our trademark application package.
